What Is an Uncontested Divorce? Is It Possible to Have an Uncontested Divorce Without Coming to Turkey?

Couples making a divorce decision have two options: contested divorce and uncontested divorce.

While a contested divorce can be a long and exhausting process, an uncontested divorce allows parties to end their marriage quickly, civilly, and smoothly by agreeing on the terms of the divorce.

Spouses who want an uncontested divorce must agree on the following:

  1. If there are children: custody, visitation days and hours
  2. If alimony or compensation is requested: amount and payment method
  3. Division of assets acquired during marriage (can be arranged even if not mandatory)

If there is mutual agreement on these issues, an uncontested divorce is possible.

Is it possible to complete this process without coming to Turkey?


Conditions for Uncontested Divorce Without Coming to Turkey:

  1. There should be no children
  2. There should be no alimony/compensation request
  3. Since the parties will not go to court, two witnesses must be present in Turkey
  4. Both spouses must give a power of attorney (can be obtained from the consulate)

If these conditions are met, the parties can have an uncontested divorce by proxy without coming to Turkey.

Otherwise, the process can be completed by coming to Turkey for just 1 day.


Uncontested Divorce Process by Coming to Turkey:

  1. Inform us of the dates you will come
  2. A power of attorney is obtained from one spouse
  3. The divorce case is filed in the desired city
  4. A date is obtained from the court
  5. The spouses attend the hearing for 5 minutes
  6. They do not need to stay in Turkey; the divorce is registered by us
  7. They can get their new IDs from the consulate
